You may have heard strange stories about people getting DUI charges on unconventional “vehicles” like lawnmowers, bicycles, or even horses. But in Canada, can you actually be charged with a DUI for riding a horse under the influence? The short answer: no.
According to Canada’s Criminal Code, DUI (driving under the influence) laws apply to individuals operating a “conveyance.” This term is defined specifically to cover motorized vehicles like cars, trucks, boats, and aircraft. Because a horse is not motorized, it does not fit the legal definition of a conveyance. Therefore, riding a horse while intoxicated does not fall under the same category as driving a car, boat, or motorcycle after drinking.
The only exception to the “motorized vehicle” requirement is a watercraft. You can get a DUI in a “vessel” which can include anything propelled by human power on the water.
Just because you can’t get a DUI on a horse doesn’t mean that you can’t still be charged. Other charges – both criminal and provincial – could still apply. For instance, if you are riding a horse while intoxicated in a public place, you could get a charge under the Liquor Control Licensing Act in BC.
Similarly, if your manner of drunken horseback riding leads to endangerment or poses a public safety risk, you could face charges under the Criminal Code of mischief endangering life or criminal negligence charges. Especially so if your DUI on a horse causes injury or death to others.
RCMP and police officers can still detain individuals who appear to be a danger to themselves or others due to intoxication, even if they’re on horseback.
