Held up by the Interlock

If you received a 90-day IRP for blowing Fail any time between September 20, 2010 and November 30, 2011, and you’re still without your license because you’re being held up by the Interlock requirement, give us a call.

We can get the Interlock requirement suspended quickly. We stopped doing it for a while for clients because we expected a decision from the Court before the end of June on the constitutional challenge. That date has come and gone without a decision. Now the Government seems to believe that this could take until the end of November. So, should you wait? No way.

The simple fact is that people are still being punished on the basis of a law that was found to violate the Charter of Rights. If you are without your license at this point because of the Interlock or Responsible Driver Program, then you are being punished on the basis of a faulty law.

It takes only a few days to get these requirements lifted. Simply call Paul or Kyla and they can deal with it for you. Ideally we need a copy of the Notice of Prohibition if you have it, or your BC drivers license number so we can get the disclosure in order to draft the necessary documents.

On a related side note, when we get the disclosure of the police Report to Superintendent for many clients we see that there is a fatal flaw in the Report that would have caused the IRP to have been lifted if the person had only contacted us back when they received the IRP. It goes to show that you should always get someone (us) to look at the Report to see if there are decent defences. It’s so sad that people end up suffering so much from an IRP when we could have succeeded on the review hearing.
