IRP Update – still no decision from the court

A number of our clients had their driving prohibitions put off (stayed) either because the OSMV didn’t render a decision, or because we filed a Petition in Supreme Court to appeal their prohibition.

We had expected a decision from the BC Supreme Court before the end of June. The OSMV and the government lawyers were also waiting for a decision. When time was running out, we decided that we needed to act with respect to our clients for whom we filed a Petition. Our concern was that their temporary licenses would expire and there would not be enough time to have extension orders approved by the Court before June 30.

Mid June, when there was still no decision from the Court, we drafted orders that we then sent to the Government lawyers. It seemed reasonable to extend the stays of the prohibitions to November 30, 2012. This was the position that the Government lawyers accepted.

Almost all of the orders were returned by the end of last week having been approved by the Court. Some were not filed because we could not locate our client to obtain instructions to file the order.

Letters went out from the OSMV to our clients confirming that their temporary driving licenses have been extended.

In the event that we did not personally speak to you about extending the prohibition, it is likely that we have not filed the order for you. What this means is that, when they have some time over at the OSMV they will notice that your court order has expired and they will then notify you that you are prohibited from driving.

For those clients who contacted our office, we thank you for your patience. It was a very busy week ensuring that all of the orders were prepared and filed with all of the correct accompanying documents and filing fees.
