Kyla Lee of Acumen Law expressed her concerns about Drager DriveTest 5000.

OTTAWA — Justice Minister Jody Wilson-Raybould is giving the green light to a new roadside test to check for drugs.

On Monday, Wilson-Raybould approved the Drager DrugTest 5000 as the first saliva screening equipment to be used by law enforcement to test for THC, the main psychoactive agent in cannabis.

“I have a lot of concerns about the timing that it is going to take to get a sample from drivers. The Supreme Court of Canada has said that the only reason that roadside testing impairment is constitutionally valid is because it is done immediately and this device requires up to 15 minutes for the processes capturing a sample and then analyzing it.”
