Kyla Lee on Global News: Bill C-46 gives officers more power

Canada’s new drunk driving laws are in effect and drivers will now face stricter penalties but it is the enhanced power of the officers that is raising questions.

Bill C-46 will give police across this country more power and if drivers refuse to blow, the consequences will be severe.

Under the old law, police were required to have reasonable suspicion a driver was impaired before they could demand a breath test. Now, when an officer says blow and you refuse, you will be hit with a $2000 minimum fine which has doubled plus a one-year driving ban and a criminal record.

Kyla: “It is something that shocks me that the government did this. Because by making the penalties significant for refusing to provide a sample, they are essentially extorting people into complying with an unconstitutional law until it is found wrong.”
