VANCOUVER (NEWS 1130) – What do you do if you are stopped for a breathalyzer but don’t have enough breath to blow?

A senior on Vancouver Island says this is what happened to her and she ended up with a 90 day suspension, owing thousands of dollars to get her and her car back on the road.

Lawyer Kyla Lee, who specializes in these issues, says the appeals process is flawed.

“The way that the deck is stacked against people – you’re going to need a lawyer.”

Lee says new roadside machines don’t offer a manual setting for unusual situations like those with medical conditions. People are told written suspension appeals are simple, but without a lawyer people lose.

“If you don’t have a lawyer and you’re trying to wade into this as a first time person with no legal background, you are going to be over your head,” she says.
