With Marijuana legalization looming, questions still remain around enforcement, specifically related to driving while under the influence of Cannabis. Some police including Vancouver police force said that the roadside marijuana testing device known as the Drager GrugTest 5000 will not be used in Vancouver.

Kyla Lee with Acumen Law joins the program to discuss developments on this issue.

“They will be using something called the standardized field sobriety test. This is a mechanism that we have had in the criminal code even prior to cannabis legalization. It has here the three psychomotor coordination tests that are done at the roadside to assess somebody’s physical ability and their cognitive ability.”

“The validation studies that have been done about the test has found that it is not reliable as a predictor for impairment by cannabis. But I don’t disagree with the use of them notwithstanding that. ”
