There is an uncertain question of law that arises as a result of red light tickets that effects every province across the country that has the potential to impact thousands of cases involving the litigation of red light camera disputes.

The issue that arises in this case from Quebec comes down to the interpretation of the offence as far as the mental health element is. There has been a long-standing debate in Canadian law about whether red light offences are offences of absolute liability or offences of strict liability.
