Seven days from a drunk driving stop

WATCH: I’m going to tell you about the first limitation period when you are issued an IRP.

Today I want to tell you one of the first things that you need to know if you just received an Immediate Roadside Prohibition. The clock is ticking. You have only seven days to file the documents necessary to challenge the prohibition.

This is extremely important. For an Immediate Roadside Prohibition, the limitation period to file the application to review the prohibition is seven days from the date that you were served the Notice of Prohibition.

If you take a look at the blue sheets of paper that the police gave you, you’ll see the one with “Notice of Driving Prohibition” written at the top in the middle. To the right there will be the IRP number. Go down to the bottom of that page on the right hand side. There is a box there where the officer fills in the date of service. That is the date when the clock starts ticking. So there’s a lot that you need to do in those seven days and you want to avoid making mistakes that can hurt your case.
