In the last video I explained that the police officer was required to submit the disclosure to RoadSafetyBC. The disclosure is a package of documents that explains what happened in your case. It lands on a fax machine at RoadSafetyBC in Victoria. Then the intake agents at RoadSafetyBC link the disclosure to your file.

The disclosure contains the critical information about your case. So why do we want to get the disclosure first from RoadSafetyBC? Because on the basis of the disclosure we can usually give you a very good idea of what work needs to be done to challenge your IRP. We can also give you a very good idea of the defences to prepare for at the appeal hearing.
When we get your disclosure we review it. We succeed in more IRP appeals than anyone, so we identify often obscure defences. We can then advise you about what steps we need to do to defend your case. If there’s something that needs to be done right away, we can get on it.

Our method of getting the disclosure is to obtain it directly from RoadSafetyBC head office which is near our downtown Victoria location.
In our experience it’s not wise to get the disclosure from ICBC Driver Services or from Service BC. The reason we say that is because occasionally, the employee at the counter or their supervisor may identify a mistake that the police officer made in their material and then correct it. We have seen cases where ICBC has corrected a botched police report and turned a winning case into a loser.
