Cannabis Impaired Driving – An Interview with Lawyer Kyla Lee

We all know that driving while impaired is unacceptable. Now that the cannabis act is in place, however, Canadians are concerned that the laws that pertain to cannabis-impaired driving aren’t based on science. In this interview, Kyla Lee, a Vancouver-based criminal defence lawyer who specializes in cannabis impairment gave her perspective on the current state of impairment laws.

She was asked if she believed that there such a thing as a threshold window like that a two nanograms per millilitre means the same thing for two individuals. Here is her response.

“No, not at all and science seems to support my opinion. There is no real threshold because unlike alcohol, and I think we made a huge mistake in Canada in legislating our impaired driving believing that cannabis and alcohol are the same thing when they are not. Unlike alcohol, your tolerance can affect it as well as how you consume it can affect your impairment even just your general health condition whether you have other underlying issues, whether you have a high concentration of body fat, all of these things go into the experience of impairment by cannabis.”
