Super 90-day IRP arguments

We’ve developed some super 90-day IRP arguments since the new Immediate Roadside Prohibition scheme came into effect last June. Part of our method is to collect and catalog as much information as possible. As a consequence, we can identify trends that call into question the reliability of the evidence presented. This has been a great advantage to our clients when we dispute prohibitions.

One of the major flaws with the IRP scheme is that you can’t cross examine the police on their evidence. The result is that the police now know that they can lie in their evidence without any consequences. We have noted, for example, that many police officers will fabricate a time of last drink. They will simply say in their report that the last drink was 2 hours earlier, or some such thing. Our clients will often tell us that the question of when they finished their last drink was never put to them.

As we accumulate more material, we can better show which police officers are more likely to lie. So we are sorting our library to help us with this.

We have been collecting information and sorting out the material we accumulate so we can quickly find the answers we need to give our clients the best defence. All of us review the disclosure in new IRP files in case we spot something that can help our clients. Often enough one of us will spot something that is directly on point.

A couple of days ago we received an email from one of our clients thanking us for succeeding in having his IRP revoked. It very well expresses the feelings people go through when they get an IRP, so we thought we would post it here.

It’s notable that you and Paul are successful in individual cases like my own while also contesting the larger matter of the provincial IRP scheme being unfair in general.

We are creative and resourceful and so we succeed in a good number of IRP cases. The most recent statistics available to us are from Government documents from July, 2012. In that month we had 5 times as many successful 90-day IRP review cases as any other law office in BC. Of course we probably also defended more IRPs than any other law office in the province in that period.  In any event, we’ve very happy for our clients and it’s nice to be appreciated for our work.

If you just received an IRP, please don’t agonize over it. Your case may be another where we can succeed in having the IRP lifted because of some documents or material we have in our library, or for some other reason that nobody has even thought of yet.
