If you have a temporary license under the old IRP scheme chances are that it expires at the end of June. Many people received a 90-day IRP for alleged Fail, and due to the current legal limbo they have only been granted a short-term B.C. driver’s license. The Sivia decision from November is under appeal, and the lawyers for the Government tell us that they do not know when the court will render a decision on what remedy will flow from the Charter violation.
There are two groups of individuals who have temporary licenses. A number of people who were in the process of disputing their IRP with the Superintendent were never given a decision and were then issued temporary licenses. We assume that either the decisions will start coming in the next few days, or the temporary licenses will be extended by ICBC Driver Services. No doubt the OSMV is aware of the issue and they will contact everyone to extend their temporary licenses before the current licenses expire, if necessary.
As for the much larger group of people, i.e. those who have court orders staying the IRP driving prohibitions until the end of June, the lawyers for the Government have asked us to draft court orders extending the licenses until November 2012. For our clients we have prepared the orders. There is a filing fee of $80 and a small fee for our services.
