Unfair DUI Laws: The Plight of Women in Vulnerable Situations

In the realm of criminal law, Driving Under the Influence (DUI) laws have long been a subject of scrutiny and debate. Of course, the aim is to deter impaired driving and promote road safety. It is crucial, however, to consider the morality and fairness of these laws, particularly when they intersect with the experiences of women in certain circumstances. The sad fact is that DUI laws can be inherently unfair to women who find themselves in vulnerable situations.

Consider women who are facing immediate threats to their safety. It is not uncommon for women to flee situations where they are being assaulted or are at risk of assault, even if it means getting behind the wheel after consuming alcohol. It is rare, but it does happen that a woman plans to stay as a guest at the home of another person. What starts out as a safe situation becomes unsafe when alcohol is involved. The option is to escape to avoid a sexual assault or some other violence. 

These decisions are often driven by strong emotions and the instinct for self-preservation. When the police stop a woman escaping a dangerous situation after having been drinking, the driver is inevitably subject to an impaired driving investigation. Imagine you live on a farm, and after drinking yourself, your husband becomes drunk and violent. You use a vehicle to escape and get caught and charged with impaired driving. Tragically, these women may find themselves facing DUI charges instead of receiving the support and protection they were seeking when they escaped. 

There are cases where women fall victim to predatory individuals who spike their drinks with drugs or excessive amounts of alcohol without their knowledge. As a result, these unsuspecting women inadvertently consume more alcohol than they intended or find themselves drugged without realizing it or having the capacity to protect themselves. In such a compromised physical and mental state, they may unknowingly drive, only to face a DUI charge. 

It is sadly not uncommon for men to drug women with the intention of sexually assaulting them in their compromised state. Women arrested for DUI when they have been drugged or had their drinks spiked are victims several times over. The DUI charges further victimize the driver.
