Kyla Lee Asks the Province to Clarify the Distracted Diving Laws

SAANICH (NEWS 1130) – It’s another case of someone getting a pricey ticket for having a cell-phone in their car’s cup-holder.

A man on Vancouver Island has taken to Twitter to share his story and it’s leading a local lawyer to demand more clarity from the province.

Vancouver lawyer Kyla Lee says it’s not illegal to have a phone in a cup holder unless you are also using it for things like GPS, or playing music.

“If you’re using it for any of those purposes, that is an additional thing beyond having the phone loose in the vehicle that constitutes use in the meaning of the Motor Vehicle Act.”

  1. We do need clarity.

    I was a passenger in a vehicle of a person having to install a interlock device for breathalyzing the driver after this person had received a IRP this past summer. With its initial demand of a breath sample for actually being able to start the vehicle I agree with. But I do not agree with its intermittent beeping asking for another sample a little later and at random intervals while driving. Is this not a electronic device that is installed by mandate of Road Safety BC? Wow wake up people. This driver was constantly worried about this little trinket continuously asking or demanding for a breath sample and then if the breath sample was properly administered or not. This driver was in my opinion distracted by a electronic device for most of the duration of our commute. I agree with having precautionary measures in place in order to avoid a repeated offence or worst, but let’s face it, how can you make a right with two wrongs. How is it that the Government can force you to break the law in order to continue the privilege of driving. There’s got to be better ways.
